Sabotage Of Triple Talaq Bill



Triple talaq a term that is Islamic divorce used by Muslim in India for instance talaq. Talaq in Arabic means divorce and used by Muslim to instance divorce in oral, written or electronic form. The use and status of triple talaq has been subject of controversy and debate. Victim women subsist life after divorce become very difficult. Reports of many case of Muslim women facing this problem lead government to look at this issue seriously. 


Government had recently crafted law for welfare of Muslim women. This law was crafted under Protection of rights on marriage. Man who breach this law would be sentenced three years of jail along with fine. Law of triple talaq was easily approved from Lok sabha where BJP has majority but it got struck in Raj sabha where BJP are not in majority. Congress party and its allies see many lacunae in this law and so they demands to send it to selection committee before its implementation in India. In Raj Sabha this bill is facing more opposition than support for making this abhorrent practice a criminal offence. 

lacunae raised by opposition party for preventing its direct implementation are 

 * whether it is justifies person's rights.
* Interference in the marriage contract in arbitrary manner.
* Making it non bailable would lead to misuse against Muslim men.
* Three years jail beside fine also matter of proportionality.
* Some see internal contradiction in law in the way it is framed, on one hand government say triple talaq in any form is void but on other hand talks about issue like custody of children and maintenance which arise only after divorce.

 These are issue that are raised by opposition which lead this bill send to selection committee.  
A legal framework to deal with this abhorrent issue of instance triple talaq had to crafted after considering these points.
A large number of Muslim women are looking forward with hope towards approval of this bill.
